Terms & Conditions – Kite-Village in Hamata
1. Participation Requirements
Participation in courses and rental of kitesurfing equipment is only permitted for persons who are physically and healthily capable of safely practicing the sport of kitesurfing.
A prerequisite for course participation is the ability to swim for at least 15 minutes without aids in open water.
For minors, written consent from a legal guardian is required.
2. Registration and Cancellation
a) Registration
Registration for courses and conclusion of rental agreements must be made in writing (including online registration form). For minors, consent from a legal guardian is additionally required.
b) Cancellation
Cancellations must be made in writing. The following cancellation conditions apply:
- up to 30 days before travel: 10 %
- 29 to 20 days before travel: 25 %
- 19 to 10 days before travel: 50 %
- 9 to 4 days before travel: 65 %
- from 3 days (72 hours) before travel: 85 %
- from start of travel or no-show: 100 %
The participant reserves the right to prove that no or a lower damage has occurred.
c) Exclusion from Course
Participants may be excluded from the course if they significantly disrupt the process, endanger themselves or others, or violate instructions from instructors. No refund will be made in this case.
3. Duty to Cooperate
In the event of service disruptions, the participant is obliged to cooperate within reasonable limits to avoid or minimize damages.
4. Safety and Instructions
For safety reasons, participants must follow the instructions of the instructors. These serve to protect all participants.
5. Care in Handling Equipment
Kitesurfing equipment is regularly inspected and maintained. Nevertheless, the participant undertakes to check the equipment independently before use and to handle it with care. Damages or irregularities must be reported immediately.
Equipment should not be left on the beach unnecessarily long (recommended max. 15 minutes), as wind and UV radiation can affect its lifespan. For damages caused by improper handling, the participant is liable within the framework of legal regulations.
6. Liability
a) General Liability
Kite-Village is liable for the careful organization and execution of courses as well as for the selection and supervision of the service providers used.
b) Limitation of Liability
Kite-Village is liable for damages within the framework of legal regulations. Liability for slight negligence causing material damage is excluded unless essential contractual obligations are affected. In case of injury to life, body or health, Kite-Village is liable according to legal regulations.
c) Personal Responsibility
Participation in kitesurfing is at your own responsibility. The participant is obliged to realistically assess his or her abilities.
d) Valuables
No liability is assumed for loss or theft of personal items (e.g., money, glasses, electronics, personal equipment), except in cases of intent or gross negligence.
7. Equipment Rental
Kite-Village is entitled to refuse the release of equipment if sufficient qualification (e.g., VDWS or IKO certification) is not available. If a lack of control or endangerment of third parties becomes apparent during use, the rental may be terminated with immediate effect.
8. Severability Clause
Should any provision of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, a regulation shall apply that comes closest to the economic purpose of the original provision.
